By accessing or using Questria ("the Service"), you ("User," "Hero," or "you") agree to be bound by these Terms of Service ("Terms" or "Covenant"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and Questria, Inc. ("Questria," "we," "us," or "our").
By clicking "I Accept," creating an account, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2.1 Eligibility
You must be at least 13 years of age to use Questria. If you are under 18, you must have parental or guardian consent.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
2.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
3. Subscription & Payments
3.1 Subscription Plans

Legendary Founder: $9.99/month or $79.99/year (limited availability)
3.2 Payment Required
A valid payment method is required to access Questria. Your subscription begins immediately upon successful payment.
3.3 Cancellation
You may cancel your subscription at any time. Access continues until the end of your billing period. No refunds for partial periods.
3.4 Price Changes
We reserve the right to change pricing with 30 days' notice. Founders pricing is locked for the lifetime of continuous subscription.
4. Intellectual Property Rights
4.1 Questria Ownership
All aspects of Questria are the exclusive property of Questria, Inc. and are protected by intellectual property laws. This includes, but is not limited to:

The Questria name, logo, and branding
•
All software, code, and technical implementations
•
The gamification system, quest mechanics, and progression systems
•
The seven-realm structure (Ironhold, Gilded Shadows, Verdant Sanctuary, Harmonic Gardens, Astral Sanctum, Ember Forge, Horizon's Edge)
•
All Sage characters and their personalities, dialogue, and visual representations
•
The guild system and all related content
•
The XP, leveling, skill tree, and achievement systems
•
The Azuki-style visual aesthetic and art direction
•
All UI/UX designs, layouts, and user flows
•
All written content, including quest descriptions and Sage wisdom
•
The AI coaching methodology and prompt structures
•
Any and all trade secrets, business methods, and proprietary processes
4.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Questria for your personal, non-commercial use only.
4.3 Restrictions
You may NOT:

Copy, modify, or distribute any part of Questria

Reverse engineer, decompile, or disassemble the Service

Remove any copyright or proprietary notices

Use Questria's intellectual property without express written permission

Create derivative works based on Questria

Sublicense, sell, or transfer your access to any third party
5.1 General Prohibitions
You agree NOT to use Questria to:

Violate any applicable laws or regulations

Infringe on intellectual property rights

Harass, abuse, or harm other users
❌
Transmit malware, viruses, or harmful code
❌
Attempt to gain unauthorized access to Questria's systems

Interfere with or disrupt the Service
❌
Use automated systems (bots, scrapers) without permission
❌
Impersonate any person or entity
❌
Collect user data without consent
5.2 Competitive Use Prohibition
YOU EXPRESSLY AGREE THAT YOU WILL NOT:
a) Create Competing Products or Services - Use any information, data, concepts, designs, mechanics, systems, methodologies, or knowledge gained from Questria to develop, create, launch, operate, or contribute to any product, service, application, or business that competes with or is substantially similar to Questria.
b) Replicate Core Concepts - Replicate, imitate, or create derivatives of Questria's core concepts, including gamified personal development applications, life-domain-to-RPG-class mapping systems, AI-powered life coaching with character personas, and quest-based goal tracking with XP/leveling mechanics.
c) Use for Competitive Intelligence - Use Questria to gather competitive intelligence, benchmark features, analyze systems, or inform the development of competing products.
d) Assist Competitors - Share, disclose, or provide any Questria information, insights, or materials to any entity that competes with or intends to compete with Questria.
This prohibition applies during your use of Questria and for a period of THREE (3) YEARS following the termination of your account.
6. AI & Data Restrictions
6.1 Prohibition on AI-Assisted Replication
YOU EXPRESSLY AGREE THAT YOU WILL NOT:
a) AI Training Prohibition - Use any Questria content, data, designs, concepts, copy, user flows, mechanics, or other materials as training data, prompts, examples, or inputs for any artificial intelligence, machine learning model, large language model (LLM), or generative AI system.
b) AI-Generated Duplication - Use any AI tool, including but not limited to ChatGPT, Claude, Gemini, Midjourney, DALL-E, Stable Diffusion, or any other generative AI system, to generate products, services, or applications similar to Questria.
c) Prompt Engineering Prohibition - Create, share, or use prompts designed to instruct AI systems to generate Questria-like products, content, or business models.
d) Data Extraction for AI - Scrape, extract, export, or collect any data from Questria for use in AI training, fine-tuning, or generation.
6.2 Data Use Restrictions

Commercial Data Use - Use any data obtained from Questria for any commercial purpose

Data Aggregation - Aggregate Questria data with other sources for non-personal purposes

Third-Party Sharing - Share Questria data with third parties for competing product development
❌
Research Without Permission - Conduct research on Questria without express written permission
7.1 Your Content
You retain ownership of content you create (e.g., custom goals, notes). By submitting content, you grant Questria a non-exclusive license to use, display, and process such content to provide the Service.
7.2 Content Standards
User content must not violate any laws, infringe on third-party rights, or contain harmful material.
7.3 Content Removal
We reserve the right to remove any content that violates these Terms.
Your use of Questria is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
9.1 "As Is" Basis
Questria is provided "as is" and "as available" without warranties of any kind, either express or implied.
9.2 No Professional Advice
Questria is a personal development tool, not a substitute for professional medical, psychological, financial, or legal advice. Always consult qualified professionals for specific concerns.
9.3 Results Not Guaranteed
Individual results vary. We do not guarantee any specific outcomes from using Questria.
10. Limitation of Liability
10.1 Limitation
To the maximum extent permitted by law, Questria shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of cause.
10.2 Cap on Liability
Our total liability shall not exceed the amount you paid to Questria in the twelve (12) months preceding the claim.
11.1 Termination by You
You may terminate your account at any time through the app settings.
11.2 Termination by Us
We may suspend or terminate your account immediately if you violate these Terms, particularly Sections 4, 5, and 6.
11.3 Effect of Termination
Upon termination:

Your license to use Questria ends immediately
•
You must cease all use of Questria materials
•
Sections 4, 5, 6, 9, 10, and 12 survive termination
•
The competitive use and AI restrictions remain in effect for THREE (3) YEARS
12. Governing Law & Disputes
12.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States.
12.2 Dispute Resolution
Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
12.3 Class Action Waiver
You waive any right to participate in class action lawsuits against Questria.
